By accessing or using any WesternGaming servers, website, Discord community, or related services ("Services"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our Services.

WesternGaming reserves the right to modify these terms at any time. Continued use of the Services after changes constitutes acceptance of the updated terms.

2. Eligibility

You must be at least 13 years of age to use WesternGaming Services. By using our Services, you confirm that you meet this age requirement and have the legal capacity to enter into these terms.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized account access
• Accept full responsibility for all activities under your account

4. Server Rules & Conduct

All users must follow the rules established for each WesternGaming server. These include but are not limited to:

• Treating all players and staff with respect
• No cheating, exploiting, hacking, or using unauthorized modifications
• No harassment, hate speech, discrimination, or offensive behavior
• No spamming, advertising, or solicitation without permission
• Following roleplay guidelines on RP servers (FiveM)
• Obeying all instructions from server moderators and administrators

Violations may result in warnings, temporary mutes, kicks, or permanent bans at the discretion of our staff team.

5. Intellectual Property

All content created by WesternGaming, including custom scripts, mods, maps, logos, and branding, is the intellectual property of WesternGaming. You may not reproduce, distribute, or use our custom content without explicit written permission.

Third-party content used on our servers remains the property of their respective owners and is used under their respective licenses.

6. Donations & Payments

All donations and purchases are final. Digital goods and perks are delivered instantly and are non-refundable once consumed. Refund requests within 14 days of purchase are reviewed on a case-by-case basis. WesternGaming reserves the right to revoke donated perks if a user is found in violation of these terms.

7. Server Availability

While we strive for maximum uptime, WesternGaming does not guarantee uninterrupted server availability. Servers may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We are not liable for any data loss resulting from server downtime.

8. Limitation of Liability

WesternGaming and its team members shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our Services. Our total liability shall not exceed the amount you have paid to WesternGaming in the past 12 months.

9. Termination

WesternGaming reserves the right to suspend or terminate your access to any or all Services at any time, with or without cause, and with or without notice. This includes account bans, server bans, and removal from community platforms.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable international laws. Any disputes arising from these terms shall be resolved through good-faith negotiation before any formal action is taken.
